Can you build a private shelter in Portugal?

Portugal has no shelter-specific law, permit, obligation or technical standard. Building work falls under ordinary municipal planning rules.

Updated 2026-10-20· 3 official sources

Short answer. Portugal has no law, permit category, declaration or obligation specific to private shelters, and no official technical standard or approval scheme for them. Any building work falls under ordinary municipal planning rules. The only official protection advice for households is to shelter inside a solid building, where a basement gives even better protection against radiation 1.

Is a private shelter legal in Portugal?

Phaenyx found no rule that targets shelters: no permit category, no declaration and no obligation for new buildings. There is also no official technical standard and no approval scheme. A shelter is therefore treated like any other construction: an excavation, a basement or an outbuilding is subject to the ordinary planning rules of your municipality (câmara municipal). Ask the municipality's urban planning department which procedure applies before any work.

Are new homes required to have a shelter?

No obligation was found: Portugal does not require shelters in new buildings.

What does the official guidance say about protection at home?

ANEPC's radiological-emergency page says that sheltering inside your home offers considerable protection against radiation and that "a cave duma casa oferece uma proteção ainda mais eficaz", a basement offers even more effective protection 1. It also asks people to shut doors and windows and turn off ventilation 1. If you already have a basement, that is the official starting point.

Portugal has no public protective shelters; evacuees go to reception centres or support zones (ZCAP) announced at the time 2.

What should I check before a project?

  1. The purpose. ANEPC's advice concerns radiological emergencies 1; Portugal also faces earthquake risk, which its national leaflet addresses 3. Tell the engineer which risks you want to plan for.
  2. Official protection advice. Shelter indoors, doors and windows shut, ventilation off; a basement is better 1.

Who should design a shelter?

A structural engineer licensed in Portugal must design anything below ground or load-bearing, together with the municipality. With no national standard, the specification is set between you, your engineer and your municipality. Phaenyx gives no construction instructions: loads, waterproofing, ventilation and exits depend on the soil, the building and local rules. Our guides explain the principles to discuss with a professional:

Frequently asked questions

Do I need a special permit for a bunker in Portugal?

No shelter-specific permit exists; the ordinary municipal planning rules apply. Check with your câmara municipal.

Is there a Portuguese shelter standard?

No official technical standard or approval scheme was found. Foreign standards can inform an engineer's design; see safe room standards.

Is a basement enough?

For radiation, ANEPC says a basement is more effective than the rest of the house 1. Whether it suits longer stays is a question for an engineer.

Is there a public shelter I can use instead?

No public protective shelters are published. Evacuees go to reception centres or ZCAP announced at the time 2. See Public shelters.
