Short answer. Malaysia has no law requiring, permitting or registering private shelters. The Civil Defence Act 1951 (Act 221) only lets the Minister make rules on "premises, structures and excavations for civil defence purposes", and no such rules for household shelters were found 1. Any underground structure falls under ordinary building approval by the local authority.
Is a home shelter required in Malaysia?
No. Unlike a few countries that require shelters in new homes, Malaysia sets no obligation for households to build or keep a shelter 1. No official source found registers, inspects or subsidises private shelters.
What does the Civil Defence Act 1951 say?
The Civil Defence Act 1951 (Act 221) is Malaysia's civil defence law. Among the rule-making powers it gives the Minister is a power covering "the provision, construction, maintenance and alteration of premises, structures and excavations for civil defence purposes" 1. This is an enabling power: it allows rules to be made, but no rules on household shelters made under it were found for these pages 1.
The version consulted is the reprint incorporating amendments up to 1 January 2006, hosted by the IFRC Southeast Asia resilience portal 1.
Do I need a permit to build a bunker in Malaysia?
There is no shelter-specific permit 1. An underground room or buried structure is still a structure, and it falls under ordinary building approval by your local authority (pihak berkuasa tempatan). Ask your local authority before any work, and expect it to look at the project as it would any other construction: plans, structure, drainage and site conditions.
Phaenyx gives no construction instructions. The structure of any shelter, especially one below ground, must be designed by a qualified engineer.
What should I think about before a project?
Even without shelter rules, several points matter. Our general guides explain them in more depth:
- Purpose. Malaysia's official public shelters are temporary evacuation centres for floods and other disasters 2; a below-ground space in a flood-prone area may be the wrong answer to the local risk. See How do you prepare for a flood?.
- Structure. Burying a container is not a simple job; see Can you bury a shipping container as a shelter?.
- Air and moisture. See How much fresh air does a shelter need? and How do you prevent condensation and mold in an underground shelter?.
- Radon. See Is radon a risk in an underground shelter or basement?.
- Protection level. See What is a shelter's protection factor?.
Is there a Malaysian standard for shelters?
No. Malaysia publishes no technical standard or certification scheme for civil-protection shelters. There is no Malaysian approval mark to look for on a shelter, door or ventilation unit. A designer may refer to foreign standards, but none is binding in Malaysia; see What standards apply to tornado and storm safe rooms?.
