Short answer. We found no shelter-specific permit or declaration for a private home shelter in South Korea's Civil Defense Act or its decrees 12. Authorities may instead order owners of buildings with a basement, other than detached single-family homes, to prepare civil defence facilities 1. A private shelter of 60 m² or more can be designated as a public shelter after consultation with its owner 2.
Do I need a permit to build a shelter at home?
No shelter-specific permit appears in the Civil Defense Act or its Enforcement Rules 12. That does not mean construction is free of rules: general building permit rules were not checked for this page. Any construction must be referred to a licensed engineer, who will also know which building formalities apply.
Can the authorities require a shelter in my building?
Yes, for some buildings. Under the Civil Defense Act art. 15(2), ministers, provincial governors and district heads may order the owners, occupants or managers of buildings to prepare civil defence facilities 1. This applies to buildings with a basement, or with required fire-safety systems, other than detached houses used as dwellings 1.
The Enforcement Rules (arts. 10 to 13) set the procedure 2:
- The owner must comply within the period set and report.
- One extension is possible, up to 6 months.
- Non-compliance leads to two reminders, then a complaint to the authorities.
If you live in an apartment building, this is the route by which basements and underground car parks become shelters; see public shelters.
Can my private shelter become a public one?
Yes. City, county and district heads may designate private shelters of 60 m² or more as public civil defence shelters, after consultation with the owner (Enforcement Rules art. 15) 2. All shelters may be used for other purposes in peacetime but must be usable immediately in an emergency (art. 14) 2.
Are there official design standards for shelters?
A national regulation on building and designating civil defence shelters is cited in public reporting, but we could not find its text online. We therefore do not present any per-person area or construction standard as confirmed. No product certification scheme for shelters was found; the Civil Defense Act sets certification only for alert terminal equipment 1.
What should I think about before starting?
These are planning questions to discuss with your engineer, not construction instructions:
- Protection level. What are you protecting against? See protection factor and the 7-10 rule on fallout.
- Air. How will occupants get fresh air, and is filtration needed? See shelter ventilation and NBC filtration.
- Alternatives. Most Korean public shelters are existing underground spaces 3; knowing the nearest one may meet your need. See shelter or evacuate.
- Container projects. If you are considering a buried container, read buried container and reinforcing a container first: both stress engineering review.
Phaenyx does not give structural instructions. Design, calculations and construction belong to a licensed engineer.
Frequently asked questions
Do I need civil defence approval to build a home shelter in South Korea?
We found no shelter-specific permit or declaration in the Civil Defense Act or its decrees 12. General building rules were not checked; ask a licensed engineer.
Can the government order me to build a shelter in my house?
Detached houses used as dwellings are excluded from the order power in art. 15(2) 1. Other buildings with a basement or required fire-safety systems can be ordered to prepare civil defence facilities 1.
What size must a shelter be to become public?
A private shelter of 60 m² or more can be designated as a public shelter, after consultation with the owner 2.
