Can I build a private shelter in Poland? What the law says

Poland's 2024 Civil Protection Act appears to set no specific permit for a private shelter; owners can seek recognition and a subsidy of up to 100%.

Short answer. We found no specific civil-protection permit or declaration for a private shelter in Poland's 2024 Civil Protection Act, though this is not yet confirmed 1. An owner can ask the municipality, district or voivode to recognise it as a protective structure. Then the owner must maintain it and open it to the public when ordered, and can receive a targeted subsidy covering up to 100% of the extra cost 1.

Do I need a permit to build a shelter at home in Poland?

Our reading of the 2024 Act (Dz.U. 2024 poz. 1907) finds no specific civil-protection permit or declaration for a private shelter in a single-family home 1. This has not yet been confirmed, and construction work falls under general building law (Prawo budowlane). Which formalities apply to a given shelter project has not been confirmed either: check with your local building authority (starostwo or city office) and a qualified designer before any work.

When authorities review buildings for possible shelter use, they leave out single-family houses and buildings with no underground floor. The Act states: "Dokonując bieżącego przeglądu obiektów budowlanych, nie uwzględnia się budynków nieposiadających kondygnacji podziemnych oraz budynków mieszkalnych jednorodzinnych" 1. In other words, a family house is not drawn into the public shelter inventory unless its owner asks.

Can my shelter be officially recognised?

Yes. Under Art. 88(3), an owner can apply for an administrative decision recognising a building as a protective structure 1. The decision includes a duty to make the structure available to the public when the civil protection authority orders it 1.

Recognition depends on meeting the technical conditions set by the Interior Ministry regulation of 4 November 2025 (Dz.U. 2025 poz. 1548) 2; the State Fire Service and building supervision check this before recognition (Art. 89, 91) 1. See our shelter standards page for the categories (U-1 to U-3, S-1 to S-3).

What obligations come with recognition?

Once recognised, the owner must 1:

  • Keep the protective structure in proper technical condition (Art. 96).
  • Cooperate in preparing it for use and appoint a shelter manager (Art. 96, 100).
  • Make it available immediately when ordered by the civil protection authority (Art. 97).

Structures in non-public buildings serve the building's own users first (Art. 104) 1.

Is there funding for building a shelter?

Yes, for recognised protective structures. Art. 106 provides a targeted subsidy for building, upgrading or preparing a protective structure, covering up to 100% of the extra investment cost 1. The subsidy is tied to the recognition route above, with its public-access duty.

What about new apartment buildings and garages?

Since the Act, underground floors of new public-use and multi-family residential buildings, and underground garages, must be designed and built so that temporary shelter places can be organised in them (Art. 94) 1. If you are buying in a new building with an underground floor, this rule applies to the developer.

What should I know before starting?

A shelter is a structural project. Phaenyx does not give construction instructions: design and construction must be done by qualified engineers, and the Polish technical regulation refers to Polish Standards for the details. Useful background reading before you talk to an engineer:

Frequently asked questions

Does a single-family home in Poland have to provide a shelter?

No such duty appears in the 2024 Act for single-family homes; they are left out of the authorities' building review 1. The design duty in Art. 94 covers new public-use and multi-family residential buildings and underground garages 1.

Does my shelter have to meet the U and S categories?

The categories are the conditions for official recognition as a protective structure 12. Even without seeking recognition, they are the Polish reference for what each level of protection means.

Who can recognise a private shelter?

The municipality, district or voivode, on the owner's application (Art. 88(3)) 1.

If my shelter is recognised, do strangers get to use it?

The recognition decision includes a duty to make it available to the public when the civil protection authority orders it (Art. 97) 1. In non-public buildings, the building's own users come first (Art. 104) 1.

How much of the cost can the state cover?

Up to 100% of the extra investment cost, through a targeted subsidy (Art. 106) 1.
