Can you build a private shelter in Germany? Rules and permits

Short answer. Germany has no shelter-specific permit and no duty for households to build a shelter ⁴¹. A private shelter is ordinary construction under the building code of your Land (Landesbauordnung) ⁶. Under the model code, erecting a building needs a building permit unless the code lists it as procedure-free ⁵. The procedure-free thresholds differ by Land: 10 m² of gross floor area in the model code, 75 m³ of gross volume in Bavaria ⁵⁸.

Do you have to build a shelter in Germany?

No. The federal Civil Protection Act (Zivilschutz- und Katastrophenhilfegesetz, ZSKG) lists shelter construction (Schutzbau) as part of civil protection. It sets no duty for households or builders to build a shelter. Its shelter provisions cover public shelters run by municipalities (§ 7) and existing house shelters (§ 8) ⁴.

Germany abandoned its shelter construction concept in 2007, by a federal decision taken with the Länder ².

What about existing house shelters?

Under § 8 ZSKG, house shelters built with federal subsidies or tax relief must be kept by the owner or user in a condition fit for their purpose. Changes that could impair their use need the consent of the authority designated by Land law, and in danger the owner must let the people the shelter is meant for use it ⁴.

The federal government says these house shelters number a high five-figure figure, covering at most 0.1% of the population, and that "Auch die Hausschutzräume wurden 2008 aus der Zivilschutzbindung entlassen" (the house shelters, too, were released from civil-protection binding in 2008) ¹. It holds no information on privately financed shelters ¹. If your house has an old subsidised shelter, ask your local building authority whether any § 8 condition still applies to it.

Do you need a building permit for a private shelter?

There is no shelter-specific permit. Building law (Bauordnungsrecht) is Land law: the 16 Landesbauordnungen follow a model code adopted by the Bauministerkonferenz, the Musterbauordnung (MBO), which has no direct legal effect itself ⁶.

The model code sets the general rule: "Die Errichtung, Änderung und Nutzungsänderung von Anlagen bedürfen der Baugenehmigung", unless the code provides otherwise (§ 59(1) MBO) ⁵. The exceptions include procedure-free projects (§ 61 MBO), such as single-storey buildings of up to 10 m² gross floor area outside the Außenbereich (undeveloped outer area) ⁵. Procedure-free projects must still comply with substantive building rules (§ 59(2) MBO) ⁵.

The Länder set their own thresholds. In Bavaria, for example, Art. 55 BayBO repeats the permit rule, and Art. 57 BayBO exempts buildings up to 75 m³ of gross volume outside the Außenbereich, and buildings without habitable rooms, toilets or fireplaces up to 20 m³ in the Außenbereich ⁷⁸.

Which procedure applies to your shelter depends on your Land, your plot and the project. Ask the building authority (Bauaufsichtsbehörde) of your municipality or district before any work. Phaenyx does not say whether a given project needs a permit.

Is there public funding for a private shelter?

None is in force. In January 2025 the federal government said it could not yet answer whether it would share the costs. It expected the cost of self-protection rooms in existing buildings to be marginal and borne by owners ¹.

Is there a German technical standard for shelters?

No current national technical standard or certification for private shelters was found in the official sources read ¹²³. The historic federal construction principles for new public shelters ("bautechnischen Grundsätze für den Neubau öffentlicher Schutzräume") gave basic protection against conventional and nuclear weapons ¹. In 2007 the federal government decided, with the Länder, to give up public shelter construction ³. The BBK says recommendations for future structural protective measures are still being evaluated ³.

In July 2026 the federal government said that the BMI and the BBK had drafted a concept for public refuge rooms and private protective rooms ("Schutzraumkonzept"). It was being coordinated with the Länder and was to go to the autumn conference of interior ministers ².

What should you consider before building?

Is it legal to have a private bunker in Germany?

Yes, as ordinary construction. No law requires or bans private shelters; the building code of your Land decides whether you need a building permit ⁴⁶⁵.
