Short answer. Brazil publishes no law, permit or declaration requirement specific to private shelters, and no Brazilian technical standard or certification for civil protection shelters was found. That does not make a shelter a free-for-all: ordinary municipal building rules apply as to any construction. Ask your municipality before starting and have a structural engineer design the work.
Is there a Brazilian law on private shelters?
None that we found. Our review of official sources found no federal law that sets a permit, a declaration or specific obligations for a private blast or fallout shelter. Brazil's civil protection law, Lei 12.608/2012, deals with disaster risk management; its shelter provision concerns temporary shelters that municipalities run for displaced people 1, not private protective structures.
Which rules apply instead?
Ordinary municipal building rules. A buried or reinforced structure is a construction project like any other, so the municipal building and land-use rules of your city apply. Contact your municipality's planning or works department, describe the project, and ask in writing which approvals and inspections are needed.
Is there a technical standard for shelters?
No. No Brazilian technical standard or certification for civil protection shelters was found. In practice, the standard your shelter meets is the one your engineer applies. Foreign references exist; our guide on safe room standards describes some of them, without implying they are legally binding in Brazil.
Who should design a shelter?
A qualified structural engineer. A shelter must carry soil and water loads, stay dry and give occupants enough air: these are design questions that depend on your site, and this page gives no construction instructions. Our guides help you prepare the conversation:
- Can you bury a shipping container as a shelter?
- What it takes to make a shipping container safe underground
- What a shelter's protection factor is
- How much fresh air a shelter needs
- How NBC air filtration works
- Humidity and mould in underground rooms
What does official Brazilian guidance recommend instead?
Brazilian guidance focuses on household readiness. São Paulo's civil defence asks families to store water and non-perishable food for three days and to choose a safe meeting place such as a library, community centre, church or relative's home 2. See our Brazil emergency supplies page and Brazil public shelters page.
Frequently asked questions
Is it legal to build a bunker on my property in Brazil?
We found no law that bans or specifically regulates private shelters. Municipal building rules still apply, so check with your municipality first.
Is there a Brazilian shelter certification?
No. No Brazilian technical standard or certification for civil protection shelters was found.
Can I build a shelter myself?
The design should come from a structural engineer, because loads, waterproofing and ventilation depend on your site. Our container guide explains why a standard container cannot simply be buried.
