Can you build a private shelter in Austria? The rules

Austria has no shelter obligation, no federal shelter permit and no federal funding; your state's building code applies. Verified 2026-10-20.

Short answer. Yes, but Austria has no federal shelter rules. Shelters fall to the nine federal states' building codes (Article 15(1) of the Federal Constitution) 1. No state law still requires them, there is no shelter-specific federal permit or funding, and no current national technical standard exists 213.

Is a shelter compulsory in Austria?

No. The former obligation to build shelters no longer exists in state law: "Mittlerweile gibt es in landesgesetzlichen Vorschriften keine Verpflichtung mehr, Schutzräume zu errichten" 21. Building one is a private choice.

Who regulates private shelters?

The states. The Interior Ministry explains: "Die Zuständigkeit zur gesetzlichen Regelung der Einrichtung und Ausgestaltung von Schutzräumen liegt aufgrund der Generalklausel in Artikel 15 Absatz 1 Bundes-Verfassungsgesetz bei den Ländern im Rahmen ihrer jeweiligen Bauordnungen" (the states are responsible for regulating shelters, within their respective building codes) 1. The federal government has no competence over shelter construction 21.

Do I need a permit?

There is no shelter-specific federal permit or declaration procedure 21. Any construction falls under your state's building code. We have not checked the specific procedure in each of the nine states, so start by asking the building authority of your municipality before you plan anything.

Is there public funding for private shelters?

No federal funding has been identified. The Interior Ministry states that it is not responsible for this area 21.

Is there an Austrian technical standard for shelters?

Austria publishes no current national technical standard or certification for shelters. In February 2026, the Interior Ministry declined to answer parliamentary questions on minimum technical requirements, citing the states' competence under their building codes; the Infrastructure Ministry declined because shelter infrastructure is outside its remit 23.

Historically, the federal Ministry of Buildings and Technology issued technical guidelines for shelter construction ("Technische Richtlinien für den Schutzraumbau"), and in 1980 a revision of the "Technische Richtlinien für Luftstoßschutzbauten" was in preparation 4. We found no evidence that these guidelines are still applied. Any remaining standards would sit in individual state building codes or regulations; none in force were identified.

In practice: treat any claim of "Austrian shelter certification" with caution, ask a supplier which technical references their design uses, and have a structural engineer assess the project for your site. Phaenyx gives no construction instructions.

What should I read before deciding?

These guides explain the concepts, not a construction method:

Before investing, make sure the basics are covered: a 14-day household stock and knowledge of the warning signals.

What can you do now, without building?

Austria has no public shelter locator 2. On the "Alarm" siren, the official instruction is to go to protective areas or rooms and follow radio or TV instructions 5. Identify the best room you can reach quickly and read our public shelters page.

Frequently asked questions

Does the federal government keep a register of private shelters?

No federal register is published, and the Interior Ministry says it cannot give shelter numbers 21.

Must new homes in Austria include a shelter?

No. No state law still requires shelters to be built 21.

Are the old federal shelter guidelines still valid?

We found no evidence that they are still applied 42.

Does a shelter sold in Austria need certification?

Austria publishes no current national technical standard or certification for shelters 23.

Can I get a federal grant for a shelter?

No federal funding has been identified 21.

Who should design a shelter?

No official source names who may design one. Shelter rules sit in your state's building code 1: ask your municipal building authority, and have a structural engineer assess the project.
